Doug Hoffman told Neil Cavuto today that the race for NY23 is still being decided.
He told Cavuto Pelosi certified the results before the State of New York certified the race.

There are still 10,000 absentee ballots to be counted.

Hoffman also took a jab at Owens for already breaking 4 of his campaign promises his first week in office including voting for the democrat’s nationalized health care plan.

    Wouldn’t that invalidate Owens’ swearing in as Congressman? The state is supposed to certify the results, then the governor is supposed to issue a certificate to the candidate that they take to the House/Senate for their confirmation and swearing in ceremony – or something along those lines from what I recall reading. So then if they skipped all the state-related stuff NY-23 legally still does not have a rep and either his vote doesn’t count on anything or anything he did vote on illegally would be nullified?

    A Democrat and he’s been in office a week and he’s ONLY broken 4 campaign promises…what a slouch.
    Let’s hope they count the military ballots this time.

    Hoffman is a maroon: he conceded. He should now just shut up until the final decision by the canvassers. IF he wins, great. If not, as is most likely, time to slip quietly into the mists ….

    As I understand it, since Hoffman conceded, the election was not contested. As such, I understand that Pelosi could swear in the congressman. Hoffman should not have conceded until the absentee votes were counted. Though it is possible the absentee ballots could put him over, it may well be unlikely, considering how many he would have to garner of the remaining ones.

    Four districts called in 0 votes for Hoffman on election night. What was going on there?

    I’d love to see this go back for a recount and investigation of the absentee ballots. The Working Families Party (ACORN) was very active in this race, which never bodes well in NYS politics.

    Not for nothing, but Pelosi was the one who signed papers certifying Obama’s birth also. I’m just saying, is it that much of a stretch knowing that she thinks she’s above the law? She needs to be investigated asap.

    Its a best a very long shot that Hoffman could still win but if you read this story it may help you to see why it was important to have Hoffman believe he was losing and to concede.

    While this appears to be good news, we are very disappointed with Hoffman that he conceded so quickly on election night thereby forfeiting many challenges he otherwise would have retained. What democrat, if separated by a mere few thousand votes would concede to a republican or conservative opponent? NONE. And this after Hoffman had to be aware of all the recent democrap shenanigans in Washington, Minnesota and elsewhere. I hope Hoffman learns the lesson, but if he loses it may be a very painful one for all concerned.

    The former Louisiana congressman who famously hid $90,000 cash in his freezer following an FBI bribery sting was sentenced to 13 years Friday, the longest term ever imposed on a congressman convicted of bribery.

    Prosecutors wanted the 62-year-old William Jefferson, a Democrat who represented parts of New Orleans, to serve at least 27 years in prison. The defense wanted less than 10 years and hoped Jefferson could remain free on bond while he appeals his conviction.

    As important as the governers’ races in VA and NJ were, I’m wondering if the Dems weren’t actually more interested in – and wanted to appear “uninvolved” in – the NY23 race.

    They needed that vote to get what’s most important to them and their agenda right now – control of our health care.

    We know what “involvement” in a race means to a Dem. It looks like their slick tricks worked again.

    Take notes, Republicans, and learn from this.

    Words are not contract. Hoffman can still be sworn in. This is going to be interesting. NY-23 can still unseat Owens. Owens lied to them anyway.

    I think you meant moron. He’s not a moron, he’s the victim of election fraud. Pelosi also certified Obama in writing, knowing full well, he is not eligibile. These people are so power hungry, they will committ fraud wherever they think they can get away with it. Pelosi belongs in prison, hopefully when everything plays out from everything related to Obama, that is where she will end up one day.

    Jerry Eaton, the Republican elections commissioner for Jefferson County, said inspectors found a problem in four districts where Hoffman’s vote total was mistakenly entered as zero.
    “Hoffman definitely gained votes where he didn’t have them,” Eaton said.
    Since 10,200 absentee ballots were distributed, and more than 1,300 returned from pro-military Jefferson Country alone have not even been counted (a more than 70% return rate on ballots distributed), there is a good chance that Dough Hoffman has won the election.

    Can the NY voters file an amicus brief (friend of the court) over equal protection rights of the voters whose ballots remain uncounted?

    What am I saying? ACORN is suing the Feds over their budget being cut. No lawsuit is too wild to be considered.

    I think the media was spinning during the reporting of the returns, ala Dan Rather calling FL while the panhandle precincts were still open. And Bush still won.

    It’s legal go time.

    I read and saw a picture of Hasan that was a member of Barry’s (transition team). He was sitting in the front roll and facing some people lined up at these tables.I think this is what the moron’s at the White House is trying to hide. Maybe we should go back and look at the pictures of Barry’s swearing in as fraud CIC.

    From the video it seems to be that the Republican candidate could still win even though he conceded. Pelosi is the biggest witch swearing in the democrat candidate when all the votes had not even been counted yet. Beeeeatch!!!     Look, I supported the guy, I even sent him money, but he conceded too damned soon, especially if he suspected any irregularities. He could simply have said ‘Mr. Owens is ahead at this point, we’ll see when all of the votes are in.” He didn’t. Hoffman conceded. I lost respect for him at that point.

    however it shakes out in the end, you have to
    admit owens is a fine example of what’s going on in washington. we need to take flood lights to his actions so far – breaking 4 campaign promises right out of the gate……… falling right in line with pelosi. sometimes you promise things you find you can’t deliver and then sometimes you promise things you know you won’t deliver [even if you could].

    He conceeded, as we would all have, because he thought the vote count was fair, honest and correct and the election was numerically out of reach.
    He can not be held responsible for information that he did not have regarding the inaccuracies.
    For the people of NY-23 and the 4 campaign promises already broken, time to vocally rail Owens out of town.

    Since this is only a one-year unexpired term, looking ahead to 2010 the Upstate New York conservative Republicans probably benefit more from the fact that Owens broke his promise on the Obamacare/Pelosicare vote within 48 hours of being sworn into office.

    Lying about what you’re going to do in your very first vote in office, with the public watching such a high-profile vote, will probably hurt far more than if the race had been contested, Owens had snuck in sometime in late November and then been able to kind of disappear into the woodwork without being on-record now for national health care would have made it easier for him next year to BS the voters about his ‘moderate’ record. Now, whomever he runs against in 2010 will have this vote as ammunition.
