9-11 terrorist attorney Scott Fenstermaker said that the 9-11 terrorists will put the US foreign policy on trial. He refused to say that innocent civilians were murdered on September 11th by the Al-Qaeda killers. He also said he will be pleased if the terrorists are released and the rule of law is followed.

Bill O’Reilly let him have it:

Dick Cheney said today that Eric Holder wants a show trial for Khalid Sheikh Mohammad.
It looks like he’ll get one.

    This guy was without morals of any kind. A complete disgrace of a human being and a waste to society. He’d probably sell family members into slavery if it got him money or fame. Heck he’d undoubtedly have raced to defend Nazi war criminals denying the Holocaust had he been alive back in the 40s.

    It isn’t the lawyers fault.Everyone including KSM has a right to an attorney and legal council.More so now that Obama has pushed this into the Civilian courts.I certainly hope that this guy does everything he can do to defend his client as opposed to the Obama brand of justice with his guarantee of a conviction and execution.Let the chips fall where they may.

    KSM does not have the right to a civilian trial. You’re living in an Obama-delusion.

    Holder could and should be impeached over this stunt.

    KSM has never received his Miranda rights. Obama, et al have been taped numerous times declaring KSM is guilty and should be punished. How can he get a ‘fair’ trial?

    KSM pleaded guilty and accepted the death penalty. He wanted an express ticket to Allah’s whorehouse in the sky. What right does he have now to counsel?

    This trial is not about KSM. Our government, military, and past administration are now the DEFENDANTS.

    Wrong. His job is to defend the client. He can acknowledge that thousands of innocents were murdered that day, and still defend his client.

    The “burden of proof” upon the US would be to prove that KSM had something to do with the atrocities committed on 9/11, not prove that thousands of innocents died that day.

    Let’s see, if the lawyer won’t concur that the people killed on 9-11 were murdered, then it means he is deferring to the nomenclature of Islamofascist as “combatants.”

    Nearly 3,000 men, women and children were violently killed that day. Civilians waiting tables, manning elevators, cooks, cleaners, secretaries, brokers, managers, cops and firefighters, passengers on airplanes, and more, everyone minding their own business. They are dead. More than those who killed the pilots and hijacked the planes were involved.

    And we’d thought his job was to try and get his clients to be declared innocent of involvement with the murders, NOT to twist and degrade the legal process to a denial of the crime itself. That “murder” never happened in the first place.

    He’s a male version of the evil Green Witch in Narnia who very persuasively and wearingly argued that the sun didn’t exist. A troll in a suit.

    This lawyer is to the core a Truther. I would not be surprised if he was the no plane theory. or the unmanned plane theory that no one died on 9-11 all 2996 are government agents and now in hiding. Many truther theory are going to be explored such as the 19 hijackers are still alive. fire does not melt steal etc. This is not only going to be trial of the Bush years and there treatment it is going to be a trial on the 9-11 commission and their findings.

    Would that not be a better defense. We did not do the thing because of Jihad but here is some conspiracy theory to why bush did it and made it look like we did it.

    No I am not. He does now thanks to this Administration.I have no delusions of Obama I have not liked any of his polices to date.This decision irks me to the core as well. But as long as KSM is allowed to be tried in this setting I do expect the American court system to follow the rules for the defendant.Yes I understand he never had his rights read to him. I do not believe he has had them read to him now.I am not even sure he has been formally charged by Holder. I understand that KSM plead guilty which will be thrown out now most likely.I didn’t say I agreed with the decision to try him this way because i don’t.

    You want just? He was pleading guilty to a military tribunal, and asking for execution, until this administration stopped it.

    You have to ask why? Why do what the whole country (90%) is against, and why make inflammatory statements about guilt and execution, that can only be used to dismiss the case and set these unhumans free.

    I would say most of the country is against this because KSM is getting tried in the wrong court. I agree it is the wrong court and none of the Admins reasons pass a smell test.I do not believe that Obama wants KSM to get off scott free.In his half baked plan he thought he could show America that the criminal justice system works to try terrorists.As Americans spoke out against this bad idea Obama spoke out of turn and guaranteed the conviction and execution. He later retracted it realizing how stupid it was to say it in the first place. If his plans are to try Bush by proxie it will backfire and it will be another failed policy of this president.It is truly sad that we have to go through this sort of insanity and b.s but it serve us well in the future as progressives get thrown out on their ear for another seventy years.

    An Argument Against Civil Criminal Trials for Terrorists.

    As if anyone can present an argument FOR civilian criminal trials for terrorists such as will soon be taking place in New York for KSM et. al. instead of military tribunals at GITMO as the Constitution allows and ALL precedence demands….

    Allowing civil criminal defenses to be used by an enemy combatant captured following an illegal act of sabotage or similar “act of war” in violation of the Law of Armed Conflict is the only thing insane in this case….

    Hey, he’s a lawyer. There had to be at least one who would defend this guy. The real anger should be directed at the policies that allowed KSM to be tried in a civilian court despite the fact that he was captured on a battlefield. They think this trial will “legitimize” us. We are getting laughed at for this. Our enemy understands strength and force. Is the Taliban changing their policies to make our people and media happy? NO. Even though they are animals, they are consistant animals. Our protections are here to protect our citizens. Don’t let our own system be used against us.

    If we give them civilian trials, this is the way their attorneys must behave. They have no choice. It is their professional duty. In fact, even in military trials they would have defense counsel who would be required to vigorously defend them, but there it would be less likely to become a public circus, etc.

    It is the president’s fault that this is happening, not the defense attorneys’.

    Here’s where the Obama/Holder plan to turn this into a show trial for the actions of the Bush Administration is going to fall apart, thanks to the Law of Unintended Consequences.

    Unless the president and the AG are planning to also change federal law on cameras being allowed in the courtroom, we’re never going to see or hear KSM & cohorts do their political theater, other than via courtroom artists’ drawings and reporters’ descriptions.     Fenstermaker is going to be the face of that, and in terms of likability, he’s miles down on the scale compared to even Ron Kuby. And while he may get a sympathetic ear from Keith Olbermann on “Countdown” nightly, he and others in the media can no more make Fenstermaker a sympathetic figure and get the majority of Americans to see things his way than the media was trying to make William Kunstler into a sympathetic one as the lead attorney for the Chicago defendants 40 years ago. As with Obamacare, where the more supporters talk, the more the poll numbers go down, the more people see of the terrorists’ lawyers and the more they hear about what’s going on in the trial, the lower Obama’s poll numbers are going to sink for allowing this show trial and the higher support will go for the Bush WOT policies.

    Since when does a fair trial have to necessarily include a blanket presumption of innocence?

    Can’t a fair trial simply mean ensuring that proper trial procedures are followed and that a client (in this case murderous scum) receives an equitable sentence ( in this case death or life imprisonment, whichever is deemed worse)?

    I’ve been generally disappointed with O’Reilly since he went mainstream/imbecile on Obama.

    But, watching this, I truly believe he’s underpaid.

    This quote illuminates the problem.

    We know that they were murdered, we saw it.

    A trial would be to determine culpability and assign the consequences.

    Why do we have to pay millions of dollars for these windbags to argue points removed from relevance?

    A judge needs to be assigned to establish guidelines and limitations on what these villains (I mean the legal ones…) can introduce. They have no business trying the United States, that has nothing to do with “whether they’ve been murdered or not”.

    And budgetary inspector needs to be asssigned to limit the amount of time they can spend on their wild goose chase. Otherwise there is an inherent conflict of interest on the part of the lawyers to spend years researching the governmental actions, for which they can charge the public.

    Has anybody in the DoJ considered that KSM’s appearence before a military commission – where he pled guilty to all charges – constitutes a TRIAL?

    And that, if he is put on trial in federal court, that would constitute a SECOND TRIAL ON THE SAME CHARGES?

    Can anyone at DoJ say DOUBLE JEOPARDY??!!

    This whole farce is nothing but a ploy to free KSM and his bunch; and put the USA, our intel agencies, our military – and George Bush on trial. Obama and his cabal are hoping that (planning on?) charges will be brought against Bush, Cheney, et alia, in the international criminal court (to which obama and holder have decided the USA shall be subject) or the world court at the hague.
    And anybody who believes that obama was not involved in “holder’s decision” to do this is a fool. It’s about the only way that they can bring anything to bear on the previous administration.

    When Air Force One did a photo op with a fighter jet in tow, the people on the ground were in a state of terror and were running in fear, only a few short months ago. People will not be able to contain their emotions when this trial begins, and there will be great rage boiling just under the surface of the skin of every New Yorker. I can only see the journey to convict these mass killers to be one that will fuel great hatred for the administration and will quicken the demise of their power. I really do not believe Americans are going to stand for this circus and go about their lives quietly…..and I can’t blame any of them.
