More Hope and Change…
The Weekly Standard is reporting that Harry Reid hid some language in the health care bill that make parts of the bill repeal proof.
Senator Jim DeMint (R-S.C.) pointed out some rather astounding language in the Senate health care bill during floor remarks tonight. First, he noted that there are a number of changes to Senate rules in the bill–and it’s supposed to take a 2/3 vote to change the rules. And then he pointed out that the Reid bill declares on page 1020 that the Independent Medicare Advisory Board cannot be repealed by future Congresses:
There’s one provision that i found particularly troubling and it’s under section c, titled “limitations on changes to this subsection.”
and i quote — “it shall not be in order in the senate or the house of representatives to consider any bill, resolution, amendment, or conference report that would repeal or otherwise change this subsection.”
this is not legislation. it’s not law. this is a rule change. it’s a pretty big deal. we will be passing a new law and at the same time creating a senate rule that makes it out of order to amend or even repeal the law.
i’m not even sure that it’s constitutional, but if it is, it most certainly is a senate rule. i don’t see why the majority party wouldn’t put this in every bill. if you like your law, you most certainly would want it to have force for future senates.
It’s bad enough that Harry Reid spent $1.2 billion of taxpayer money to buy the votes for Obamacare. It’s worse that he snuck this language in the unpopular bill that will make it impossible to repeal.

I do not believe that this provision will be anything more than a ’speed bump’ for a future Congress. There is at least a tradition, if not a rule, that no Congress can bind a future Congress. This insertion is a sleazy attempt to circumvent that, but can certainly be ignored.

Not only did he have the nads to insert THAT language for the Senate, but he included the House of Representatives! Now, how’s that for audacity!!??
The legal paperwork is being drawn up, as we speak, so that the second O Bomber puts his autograph to the legislation, it will be challenged as un-Constitutional in at least two or three areas and for as many reasons. He can’t legally bind future Senates and he most certainly can’t force rules upon the House.
Now…Keep digging, sports fans, because I’m sure there’s more shenanigans included that we haven’t even seen yet. I feel quite certain there isn’t ONE among the HUNDRED members of the Senate who has read the bill they passed!

Health care bill clears 2nd Senate hurdle Tues.
[WASHINGTON – Two down and one to go. The health
care bill has passed another 60-vote test in the Senate.
Democrats remained united as they started voting at sunrise Tuesday, pushing toward their goal of passing President Barack Obama's health
care overhaul by Christmas.
With not a vote to spare, the Senate voted 60-39 to shut off debate on Majority Leader Harry Reid's version of the bill. An earlier vote to approve a 400-page package of changes that sealed Democratic support for the health care bill also passed 60-39, though only a simple majority was required. No Republicans voted in favor.
With partisan feelings running high, Reid appealed to senators to forgo personal attacks. Democrats must pass another 60-vote test Wednesday before they vote on final passage, expected to come on Christmas Eve.

Yes, we can! We can appeal it when the Republican take control of both US House and US Senate in 2011 after the 2010 election is over. Sen. Harry Reid from Nevada won’t be there anymore. Mr. Reid has lied to the American people and doesn’t want us to know what is on his health care bill plan. He doesn’t know any thing about medical care and Mr. Reid is not a doctor. I hope some of these medical doctors are running for Congress or US Senate next year. I hope they are good Republican. Just like Rep. Ron Paul’s son from Kentucky is running for the US Senate next year. I hope Dr. Paul can win.

But this current crop of legislators think they can call “1-2-3-no changies” like the spoiled brat children they are and they deserve to have their piece o junk legislation enshrined forever?

They often say that you don’t want to see sausage being made. Perhaps there are things that shouldn’t be in sausage then. They are trying to say that you don’t want to see the bribes, corruption, payoffs and coercion that are involved in making legislation? Perhaps there are things that should not be involved in legislation. Looking at a little used document called the Constitution would be a good start. One problem with elevating non-constitutionally enumerated issues to a national level, besides creating unnecessary political division, is that to get a bill passed, you have to hang so much sweetener on the thing it can’t be efficient. If there isn’t a natural common ground it probably shouldn’t be done.
Promise of transparent government – delivered! This must be the most openly corrupt government in my lifetime.

Until we revoke the labor exclusion clause from the Clayton Act which shields unions from anti-trust restrictions we will continually face the leftist onslaught that pits the government (the union stronghold of leftist thinking) against us commoners. Is it any wonder that our own government is always working against us, and that its expansion continues and even accellerates during economic downturns? It’s all about the SEIU!!!!
