Dan Winslow, counsel for the Scott Brown for U.S. Senate campaign, will hold a media availability to announce the filing of a criminal complaint against the Massachusetts Democratic Party regarding a recent mailing paid for and sent by the Massachusetts Democratic Party. Winslow will make a statement and take reporters’ questions at MassGOP Headquarters in Boston TODAY at 4:00 PM.

Scott Brown filed this complaint against the SEIU in December.
FOX News Boston reported:
BOSTON – Republican Senate hopeful Scott Brown has filed a complaint with the State Ethics Commission after a report that a union backing rival Martha Coakley used state resources to urge workers to volunteer for Coakley’s campaign.
The report by FOX25 said the Service Employees International Union used state computers and e-mail addresses to direct state employees to volunteer for Coakley, the Democratic state attorney general.
UPDATE: Today’s complaint was in response to this horrible Democrat Party mailer:

The Washington Post reported:
Republican Scott Brown charged Saturday that a Democratic mailing against his U.S. Senate campaign violates a Massachusetts law prohibiting false statements against a political candidate.
The cover of a four-page mailer sent by the Massachusetts Democratic Party says, “1,736 women were raped in Massachusetts in 2008. Scott Brown wants hospitals to turn them all away.”
Brown is a state senator, and in 2005 he filed an amendment that would have allowed workers at religious hospitals or with firmly held religious beliefs to avoid giving emergency contraception to rape victims. The amendment failed, and Brown voted in favor of a bill allowing the contraception. He also voted to override a veto issued by his fellow Republican, then-Gov. Mitt Romney.
UPDATE: Even some hardcore liberals are upset with the Coakley rape ad.
UPDATE: The penalty is $1,000 or up to 6 months in jail.
A section of the Massachusetts General Laws prohibits false statements against political candidates that are designed or tend “to aid or to injure or defeat such candidate,” with a penalty of to $1,000 fine and up to six months in prison.
Brown campaign legal counsel Daniel Winslow said, “People can shade things and spin things, but it has to have some kernel of truth.”
Brown is locked in a dead heat with Democrat Martha Coakley, the state’s attorney general, in the race to succeed the late Sen. Edward Kennedy. Independent Joseph L. Kennedy, who is not related to the famed Kennedy family, is also on Tuesday’s ballot.
Winslow called on the Democratic Party and the Coakley campaign to disavow the mailer’s claim. The Brown campaign plans to wait until Tuesday, the next business day, before seeking a legal remedy, he said.

This is actually great timing. Coakley, the MA Attorney General, has now 1) committed copyright infringement on UPS’s slogan, and 2) slandered Brown about rape victims, and 3) accepted illegal assistance from SEIU who used state resources to campaign for her. All of this stuff hits the fan on Saturday… and you know who is coming to town tomorrow. How is Obama going to get up there on stage with an Attorney General who just committed THREE CRIMES and endorse her for Senate? He’ll do it… and flush any remaining credibility down the toilet.

Clearly, this union is not a labor union in any traditional sense. Union members ought to demand an audit of their books. My guess is that the union Pension and Health and Benefit funds are near bankrupt after having spent so much to get Dems elected. they are sellling their members down the river. It is a front for the Communists, and it is so much a part of the Democrat operation that they can go into government offices and use government computers. This kind of crap has been going on for years – public employee unions using state resources to assist democrat canditates. During the Reagan-Mondale campaign I was teaching a class of 30 or 40 state employees in Detroit. As we broke for lunch at noon, an MSEA rep (a state employee union representing a large chunk of the state civil service workforce) came into the room and announced that department heads had authorized anyone who wanted to skip the afternoon session to attend a Mondale rally in Detroit. Only a few of my class returned after lunch.
Several weeks later Reagan was in town. Needless to say, no similar announcement was made for that rally, and I suspect any state employee who had skipped class to attend the Gipper’s rally would have been subject to disciplinary action had the absence come to the attention of departmental management.

From a MA resident- don’t be fooled. Timing is everything. The MA Democrats know what they did is illegal. All of the legal action occurred today. Obama is in town Sunday. Monday is a holiday (MLK Day). The election is Tuesday,and the apologies start on Wednesday.

The state law is unconstitutional. False speech is protected by the First Amendment. Brown can sue Coakley or the Democratic party for defamation. But a law prohibiting false speech especially in a political race is definitely unconstitutional. Brown’s lawyer should check Times v. Sullivan, one of many cases in which the Supreme Court ruled that there is no truth test for First Amendment protection. By the way, Times v. Sullivan was a landmark case that advanced the cause of Free Speech. Brown is getting mistaken legal advice.

You know, the biggest issue I have with the Demo-rat ad is… there were almost 1,800 rape cases in little Mass. in 2008?

The ad is a scandal, no doubt. But… what are the Demo-rats doing about this amount of rapes? Nothing? Tell the women “oh, you provoked it”? I mean, that’s how Dems tick, don’t they? It’s always the victim’s fault.
